Terms of Service

These Terms of Service ("Terms") govern your use of the website at whisperliminals.com (the "Site"), operated by RESTorative Co. LLC ("we," "us," "our"). By using the Site you agree to these Terms. If you do not agree, do not use the Site.

The Whisperliminals app at app.whisperliminals.com has its own Terms of Service that govern use of the app itself.

The rules for Share with a Friend, the reward members get for referring a friend in the app, are in the Share with a Friend section of the app's Terms.

The Site is intended for users 18 years of age or older. If you are between 13 and 17, you may use the Site only with the permission and active supervision of a parent or legal guardian who agrees to these Terms on your behalf. By using the Site on behalf of a minor, the parent or guardian represents that they have full legal authority to do so. Children under 13 may not use the Site under any circumstances.

You also represent that you have lawful capacity to enter this agreement and that your use of the Site won't violate any law or regulation that applies to you.

The Site is the marketing surface for the Whisperliminals app. It provides information about the product, accepts newsletter signups and contact inquiries, and directs interested visitors to the app and to subscription checkout. The Site uses advertising tools to attribute conversions and build audiences for ads on Meta platforms.

When you click a subscribe link on the Site, you are redirected to Whop's checkout. Whop processes the payment and handles billing under their terms.

Refund terms are per tier. Lifetime includes a money-back guarantee of at least 30 days from the date of purchase, processed through Whop's refund flow. Where a specific offer states a longer window, the longer window governs. Plus is cancel-anytime and has no money-back window. Pro includes a 7-day free trial, which is its evaluation period, and has no money-back window after the trial converts.

The Pro tier offers a 7-day free trial; Plus and Lifetime tiers do not. Any "free trial" language on the Site refers specifically to the Pro tier.

Termination for cause. If we terminate your account for cause – for example for violation of these Terms, fraudulent activity, or conduct that poses a security risk – the refund terms above do not apply, including any Lifetime money-back guarantee, however long the applicable window. Where no payment has been taken, we will not charge you; where payment has already been taken, it is not refundable. Nothing in this section limits rights you may have under applicable law.

You agree not to:

• Scrape, crawl, or extract content from the Site by automated means without our prior written consent.
• Reverse-engineer, decompile, or otherwise attempt to derive source code from the Site.
• Impersonate any person or misrepresent your affiliation with any organization.
• Submit fraudulent, misleading, or harmful information through any form on the Site.
• Use the Site or its contact channels to send unsolicited commercial messages.
• Interfere with the Site's normal operation or attempt to circumvent its security measures.

All content on the Site – text, graphics, copy, logos, branding, software, and the overall design – is owned by RESTorative Co. LLC or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Site without our prior written permission.

If you submit feedback, ideas, or suggestions to us ("Submissions"), you grant us a perpetual, worldwide, royalty-free, irrevocable license to use, modify, and incorporate them without compensation. We have no obligation to keep Submissions confidential.

Whisperliminals is a wellness tool. It is not medical advice, diagnosis, or treatment. The Site and the app are not substitutes for evaluation or treatment by a qualified medical professional. If you have insomnia, a sleep disorder, or any other medical concern, consult a clinician. We make no guarantees of any health, performance, or sleep outcomes.

To the maximum extent permitted by law, our total aggregate liability for any claim arising from or related to these Terms or your use of the Site is limited to the greater of $100 or the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages – even if we've been advised of the possibility.

Some jurisdictions don't allow limitations of liability for certain damages, so the above limits may not apply to you in full.

You agree to indemnify, defend, and hold harmless RESTorative Co. LLC, its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any third-party rights.

You may stop using the Site at any time. We may suspend or terminate your access to the Site at our discretion, with or without notice, for conduct that we believe violates these Terms or harms other users or our legitimate interests.

Sections of these Terms that should reasonably survive termination do – including intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles.

Informal resolution first

Before either of us files a formal arbitration claim, we agree to try to resolve the dispute informally for 30 days. Send a written notice describing the dispute to [email protected] (or to your address on file if we're the ones initiating).

Mandatory arbitration

If we can't resolve the dispute informally, any claim arising from or related to these Terms will be resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association. Arbitration will take place in Wyoming or remotely by your election. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.

Class-action waiver

You and we agree that any dispute must be brought individually, not as part of a class, collective, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class proceeding.

Small-claims-court carve-out

Either party may bring a claim in small-claims court if it qualifies, instead of in arbitration.

We respect copyright. If you believe content on the Site infringes a copyright you own or control, send a written notice to [email protected] including:

• Your physical or electronic signature.
• Identification of the copyrighted work you claim has been infringed.
• Identification of the allegedly infringing material on the Site, with enough detail for us to locate it.
• Your contact information (name, address, phone, email).
• A statement that you have a good-faith belief that the use is not authorized.
• A statement, under penalty of perjury, that the information in the notice is accurate and that you're authorized to act on the copyright owner's behalf.

If we remove material in response to a DMCA notice, we'll notify the person who posted it and provide a counter-notice process. We terminate accounts of repeat infringers.

We may update these Terms from time to time. The Effective Date at the top of this page reflects the current version. If we make material changes, we'll notify newsletter subscribers by email and post a banner on the Site. Continued use of the Site after changes become effective means you accept the updated Terms.

These Terms (together with our Privacy Policy and Cookie Policy ) are the entire agreement between you and us regarding the Site. If any provision is held unenforceable, the remaining provisions stay in effect. Our failure to enforce any right or provision is not a waiver. Section headings are for convenience only and don't affect interpretation.
